1. Scope and who we are
These terms and conditions govern yacht and boat charter bookings made through loscaballosmodelcars.es, operated under the brand Mallorca Yachts for Rent. We arrange crewed day charters and longer charters on yachts based in Mallorca, Spain.
By sending an enquiry or confirming a booking, the client accepts these terms. Questions about a booking or about these terms should be sent to [email protected].
2. Enquiries and booking confirmation
Charters are not paid for, or booked automatically, on the website. A visitor sends an enquiry through the form, or contacts us by email, phone or WhatsApp, giving the dates, number of guests and, if known, the yacht of interest.
We reply with a written quote stating the yacht, dates, price and inclusions. A booking only becomes binding once we confirm it in writing and the deposit set out below is received; a quote on its own is not a confirmed booking.
3. Prices, inclusions and right of withdrawal
The site lists 30 yachts, from day-boats to superyachts, with day rates from €1,700. Built around short premium outings and sunset departures, we also plan 2-4 hour evening cruises into the Bay of Palma, departing from Puerto Portals or Club de Mar.
The price stated in the written quote is the charter fee for the agreed yacht, dates and itinerary. Fuel, marina fees, APA (advance provisioning allowance) on larger yachts, catering and any other extras are charged only as stated in the written quote; nothing is added afterwards that was not quoted.
A charter is a leisure service booked for a specific date. Under Article 16(l) of Directive 2011/83/EU, and under Article 103(l) of the Spanish Royal Legislative Decree 1/2007, the general 14-day right of withdrawal for distance contracts does not apply to this type of booking. Cancellation of a confirmed charter is instead governed by the voluntary policy set out below.
4. Payment and deposit
- A deposit of 40% of the charter fee confirms the booking.
- The balance is due 10 days before departure.
- Payment instructions are given in the written quote; we do not take payment directly on the website.
5. Cancellation and changes by the client
Cancellation must be sent in writing by email to [email protected]; the date we receive it is the date that counts for the rules below.
- More than 21 days before departure: the deposit is refunded in full.
- Between 10 and 21 days before departure: the deposit is retained.
- Less than 10 days before departure: the full charter fee is due.
A change of dates or yacht requested by the client is treated as a cancellation and a new booking, unless we agree in writing to handle it differently.
6. Cancellation by us, weather and the captain's authority
We may need to cancel or alter a charter for reasons outside our control, including adverse weather, a port authority restriction, a technical problem with the yacht, or force majeure.
If the captain or the port authority considers conditions unsafe, the client chooses between a free new date and a full refund; no other compensation applies. The captain's decision on safety is final and may be taken at any point before or during the charter, including a decision to shorten, change or end the outing.
7. Guests, conduct and the itinerary
Guest numbers may not exceed the vessel's licensed capacity. The crew may refuse boarding to anyone who endangers the safety of the yacht, crew or other guests, including anyone visibly unfit to board.
The itinerary described in the written quote, whether it stays within the Bay of Palma or extends further along the coast, is the planned route; the captain may change it at any time for safety, weather, port or technical reasons. Guests follow the crew's instructions on board at all times, including on swimming, water sports, smoking and the use of yacht equipment.
8. Damage, personal belongings and liability
The client is responsible for damage to the yacht or its equipment caused by guests during the charter, beyond normal wear and tear. Personal belongings brought on board remain the guest's own responsibility; we do not accept liability for their loss, theft or damage.
Our liability is limited to the charter fee paid for the booking concerned and does not extend to indirect loss, missed connections or consequential loss, except where liability cannot be limited under mandatory Spanish law.
9. Complaints and use of the website
Complaints about a charter should be sent to [email protected] as soon as possible so we can look into them while the details are fresh.
The content of loscaballosmodelcars.es, including yacht descriptions, images and pricing, is published for the purpose of charter enquiries and may not be copied or reused for another business. We may update yacht details, availability and day rates on the site at any time; the price that applies to a booking is the one stated in the written quote, not a later change to the site.
10. Governing law, jurisdiction and changes to these terms
These terms are governed by Spanish law. Any dispute arising from a booking is submitted to the courts of Spain, without prejudice to any mandatory consumer forum that applies to the client.
We may update these terms for future bookings. The version in force on the date a booking is confirmed in writing is the one that applies to that booking.
